THE ROLE

The LegalCounsel - Claims is responsible for leading the handling of cargo

claims and related incidents, with a strong focus on loss prevention, legal

risk mitigation, and recovery from liable third parties. The role also includes

providing legal support to MSC Agencies and ensuring adherence to company

procedures.

YOUR IMPACT

As Legal Counsel - Claims you will :

In

respect of the handling of claims and incidents :

• Liaise with MSC agents and the other MSC HQ departments (operations, planning, chartering, documentation, liners, Medlog, etc…) with a view to organise the handling of incidents and claims to limit our financial, operational and legal exposure.
• Identify in each country suitable experts and lawyers.
• Retain, appoint and coordinate surveys and legal actions.
• Investigate cargo and non-cargo-related incidents / casualties to assess liabilities and extent of damage (ex : injuries, damage to vessel, quay, rail accidents, etc…).
• Receive and analyse claims submissions and notices of claims.
• Identify liable third parties and organise recovery actions.
• Manage autonomously all insurance-covered litigation (whether above or below policy deductible) with a view to mitigate losses, maximise recoveries and save costs.
• Negotiate claim settlements with customers, terminals, vessel owners,..
